Additionally, registered Users accessing the password-protected area of the Site agree to immediately contact Quest if there is any change in their eligibility status as (i) an “accredited investor” as that term is defined in Regulation D of the U.S. Securities and Exchange Commission promulgated under the Securities Act, (ii) a “qualified purchaser” within the meaning of Section 2(a)(51) of the Investment Company Act of 1940, as amended (the “1940 Act”), and (iii) a “qualified eligible person” as defined under CFTC Regulation 4.7. Users will not hold Quest liable for any delays, inaccuracies, errors or omissions there from or in the transmission or delivery of all or any part of the Site, the Material or for any damage arising from any of the foregoing.
IN NO EVENT WILL QUEST BE LIABLE TO A USER OR ANYONE ELSE FOR ANY DECISION MADE OR ACTION TAKEN BY THEM IN RELIANCE ON THE MATERIALS.
